Dear Mr. Dillon:
This is in response to your letters dated March 23, 1981, and April 15, 1981 in wnich you requested, pursuant to the Freedom of Information Act, documents relating to the February 1978 investigation into allegations concerning the Hayward Tyler Pump Company.
The documents listed on Appendix A are enclosed and are being placed in the NRC Public Document Room (PDR), l'17 il Street, N.W., Washington, D.C.
The documents listed on Appendix B are investigatory records compiled for law enforcement purposes.
Portions of documents 1, 8 and 9 are being withheld from public disclosure pursuant to exemption (7)(C) cf the Freedom of Infonnation Act (5 U.S.C. 552(b)(7)(C)) and 10 CFR 9.5(a)(7)(iii) of the Commission's regulations because disclosure of the information would constitute an unwarranted invasion of personal privacy.
Portions of documents 2 through 7, 8 and 9 are being withheld from public disclosure pursuant to exemption (7)(D) of the Freedom of Information Act (5 U.S.C. 552(b)(7)(D)) and 10 CFR 9.5(a)(7)(iv) of the Commission's regulations because disclosure of the information would disclose the identity of the confidential source.
The non-exempt portions of these documents are enclosed and will be placed in the NRC PDR.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the partial denial of documents 2 through 7 and certain portions of documents 8 and 9 of Appendix B are the undersigned and Mr. Victor Stello, Director, Office of Inspection and Enforcement.
