Dear Governor Clements:

Thank you for your letter of May 13, 1981 to Comissioner Ahearne.

I am pleased to learn of the progress in Texas to comply with the provisions of the Uranium Mill Tailings Radiation Control Act, as amended. Since your letter, I have learned from our Office of State Programs that Texas S.B. 735 has passed and has been signed by you.

I appreciated your response to our concerns over the need to upgrade tailings management at the two existing conventional mills. NRC staff will review these cases at the next routine review of the Texas Radiation Control Program which we expect to conduct in early 1982.

I have asked G. Wayne Kerr, Director of the NRC Office of State Programs, to continue to work directly with the Texas Department of Health for the purpose of signing an amendment to our Agreement by November 8,1981.

It is quite important now that Texas legislative actions have been concluded, that we move quickly to discuss your plans for implementing regulations and to prepare the necessary documents to support the request for the amendment. We look forward to meeting with the Department of Health at the earliest possible date.
