i APPENDIX A NOTICE OF VIOLATION Combustion Ecgineering, Inc.
Docket No. 70-1100 License No. SNM-1067 As a result of the inspection conducted on February 25-27, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified:
A.
Condition No. 9 of Special Nuclear Material License No. SNM-1067 states, in part:
"For use in accordance with the specifications in Sections 7, 8,10,12,13,14,15,19...of the licensee's application... dated April 16, 1973...".
Section 15.12 of the licensee's April 16, 1973, application requires that various types of environmental samples be collected and analyzed at the frequencies cited in Table 15.1.
Contrary te the above, during 1980, environmental samples were collected at the retaired frequencies, but the samples were not analyzed as required.
This is a Severity Level IV Violation (Supplement VI).
B.
10 CFR 20.205(d), " Procedures for picking up, receiving, and opening packages," states:
"Each licensee shall establish and maintain procedures for safely opening packages in which licensed material is received, and shall assure that such procedures are followed and that due consideration is given to special instructions for the type of package being opened."
Contrary to the above, the licensee received packages containing licensed material on February 12, 1981, and February 17, 1981, opened and unloaded the packages, and the licensee did not have procedures for safely opening the packages.
This is a Severity Level V Violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering, Inc. is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
