Dear Mr. Jones:

This is in response to your letter of July 9,1980, as supplemented May 20, 1981, wherein you requested relief from the ASME Code requirements for the inservice testing (exercising) of check valves SI-159 and SI-160.

As discussed in the enclosed Safety Evaluation, relief from tt e ASME Code requirements for inservice testing of these valves is hereby granted, subject to the alternative examinations and conditions discussed therein.

The relief granted herein expires on September 26, 1983, which is 10 years following the date of commercial operation of Fort Calhoun Station, Unit No. 1.

While not explicitly stated in our July 2,1979 letter, tne relief granted in that letter and related Safety Evaluation Recort also expires on September 26, 1983.

This relief is based upon our review of the information you submitted to support your determination that compliance with the ASME Code inservice testing requirements with respect to valves SI-159 and SI-160 would be impractical for your facility. We have determined that the testing from which relief is sought is impractical and pursuant to 10 CFR { 50.55a (g)(6)(i), that the granting of this relief is authorized by law and will not endanger life or property, or the common defense and security, and is otherwise in the public interest.

In making this determination we have given due consideration to the burden that could result if these require-ments were imposed on your facility. We have determined that the grantirig of this relief does not involve a significant increase in the probability or consequences of an accident nor a significant decrease in safety margin; and thus, does not involve a significant hazards consideration.

Further-more, we have determined that the granting of this relief from ASME Code requirements does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any significant environmental impact. I is insignificant from the standpoint of enviror-aental impact and pursuant to 10 CFR 51.5(d)(4) that neither an environmental impact statement nor a negative declaration and environmental impact appraisal needs to be prepared in connection with this action.

A copy of the Federal Register Notice is also enclosed.
