.This refers to the Nuclear . Regulatory Commission (NRC) special inspection

conducted by P. Harmon from January 8-12, 1990.

At the conclusion of the

Einspection, the findings were discussed with those members of your staff

'

identified in the enclosed inspection report.

The areas examined during this inspection are those associated with your Safety

p

Evaluation Program .in relation to the requirements specified in 10 CFR 50.59,

Within -these areas, the inspection consisted of selective examinations of

o

procedures and representative records, and interviews with personnel.

.The inspection findings indicate that certain activities appear to violate NRC

requirements.

The . identified violation involved one example of failure.

to perform an adequate design change and to perform an adequate safety

evaluation - prior to -implementing a design change which removed the freeze

protection from the Unit 1 Refueling Water Storage Tank level transmitters.

'The violation, references to pertinent requirements, and elements to be

included in your response are described in the enclosed Notice of Violation.

[.

Two additional apparent violations were identified which involved one example

of a-failure to perform an adequate safety evaluation prior to implementing a

revision to an Emergency Instruction and one example of inadequate corrective

action involving deadheading of the Residual Heat Removal pumps.

These

apparent violations are under consideration for escalated enforcement action.

Accordingly, no Notice of Violation is being issued at thic time, and no

response to these apparent violations is required. However, please be advised

,

'that the number and characterization of these apparent violations may change

as a result of NRC review. An Enforcement Conference to discuss these apparent

violations has been scheduled for February 14, 1990. You will be advised by

separate correspondence of the results of our deliberations on this matter.
