Our letter and the Notice described a violation identified during.an ins 8-9, 1989, at Louisiana-Power'. '& Light Company'sL (LP&L)pection conducted on March 'Waterford nuclear power plant. This violation LP&L's failure to test the plant's High Pressure Safety Injection (HPSI) involved E pumps in accordance with' applicable requirements and the resultant failure to recognize. H a condition, in November-1988, that should have caused LP&L to declare one of these. pumps inoperable and take certain required actions. To emphasize the importance of assuring that surveillance procedures contain. l adequate ~ acceptance: criteria and'the 'importance of promptly assessing conditions -i that may: affect the. operability of important safety systems, a civil penalty of Fifty Thousand: Dollars ($50,000)'was-proposed. L In your. response, you admitted-to having violated Waterford Technical i" Specification 4.0.5.a'but attributed this violation to a misunderstanding- 'between LP&L and the NRC. LP&L also-requested NRC..to reduce Lthe severity gj level of the violation and to fully mitigate.the-proposed civil penalty, i Further,< LP&L requested that should the NRC conclude a civil penalty is-still warranted after considering the company's arguments, it should mitigate the. fine-in its entirety with the amount of the mitigated fine being offset by i LP&L's payment of an equal amount to Nichols State University. ' After consideration of your response, we have concluded, for the reasons given b in the Appendix. attached to the enclosed Order Imposing Civil Penalty, that the L: violation ~ occurred as stated in the original Notice and that the proposed' civil? penalty should-be imposed by Order. In addition', the NRC has not changed its position that it is inappropriate to mitigate a civil penalty and permit a licensee to donate an equal amount to an educational institution.
