Previous NRC review of Licensee Event
Report 89-10-exercised ermecement discretion per 10 CFR Part 2 Appendix C,
.Section V.6.1; however, previous corrective actions were deemed ineffective.
This violation has been categorized by severity level in accordance with the
'" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy). You are-required to respond to this
letter and in preparing your response, you should follow the instructions in
Appendix A.
In addition, another one of your activities apparently was not conducted-in
full compliance with NRC and the Department of Transportation requirements.
The apparent violation involves a Millstone Station shipment of a limited
cquantity of radioactive materials that had a dose rate on contact with the
-
package in excess of the 49 CFR limits of 0.5 mr/hr.
This matter is under NRC

staff review and will br addressed in separate correspondence.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of
