I Gentlemen: This refers to an inspection conducted on October 30, 1980, by a representative of the Department of Social and Health Services, State of Washington, of a waste shipment from the Prairie Island Nuclear Generating Station upon arrival of the shipment at the Richland, Washington low-level waste burial site. During the inspection, a radiation level that exceeded the limit permitted by regula-tions of the Nuclear Regulatory Commission was measured on the external surface of the transport vehicle which is of significant regulatory concern. The results of the State's inspection were conveyed to your company by letter dated November 6, 1980, from the State of Washington. Supplement V of the NRC's Proposed General Statement of Policy published in the Federal Register (45 FR 66754) October 7, 1980, sets forth the severity levels for violations of transportation regulations. The violation; have been cate-gorized at the severity levels described in Appendix A. You are required to respond to this letter, and in preparing your response you should follow the instructions in Appendix A. The violations for which you have been cited have already been the subject of enforcement action by the State of Washington. On November 6, 1980, the State of Washington suspended your burial permit and reinstated it on November 10, l 1980. In view of the circumstances surrounding this matter, we have exercised l our discretion under the Interim Enforcement Policy (45 FR 66754) October 7, l 1980, and have chosen to issue at this time the enclosed Notice of Violation. After reviewing your response to this Notice of Violation and your proposed l corrective actions, the NRC will determine whether further NRC enforcement l action is necessary in order to ensure compliance with NRC regulatory require-ments.
