Dear Mr. Denton:
On June 8, 1981 Mr. R. A. Birkel, ONRR, requested that Duke Power Company address the following areas regarding the proposed full porer licensing of McGuire Unit 1:
A.
McGuire Technical Specification coverage of the valves in the drain lines between upper and lower containment; B.
FEMA's letter of June 4, 1981 regarding the operability of the emergency notification system; C.
Duke's ability to meet the license conditions contained in the June 5, 1981 draft McGuire license by the specified times; D.
Duke's ability to meet the dated requirements of NUREG 0694 as
" clarified" by NUREG 0737 by the specified dates.

A.
By letter dated June 5, 1981 Duke described the administrative controls which preclude improper valve position in the drain lines between upper and lower containment. In addition to these administrative controls the McGuire Technical Specifications require that for normal operation these valves be verified locked open and periodically inspected for debris.

Duke's emergency notification system is installed and scheduled to be completely operable by July 1, 1981.

Efforts are underway to meet each of the proposed license condi-tions by the times specified. However, for certain conditions there is very little margin between the scheduled and the required completion dates. These conditions are:
- 1) 10e post accident sampling, 2) 10f(1) res; tor vessel level, and 3) 10f(3) upgrade in-core thermocouple monitoring. For other conditions Duke is participating in cooperative agreements with other utilities either through the Westinghouse Owners Group or EPRI. These cooperative efforts are scheduled to meet the proposed conditions by the time specified. However, it should be noted that Duke cannot unilaterally assure that the schedules will not slip.

The document " Duke Power Company, McGuire Nuclear Station, Response to TMI Concerns" describee how Duke will meet the dated requirements of NUREG 0694 as " clarified by NURIG 0737. Each of these items are currently scheduled to be completed by the specified date.
