The purposes of this letter are to acknowledge receipt of your letter dated October 23, 1980, requesting pennission to refill Lake Lee, and to grant that request.

Originally, NRC requested that G.E. drain Lake Lee due to a lack of specific information on the potential for flooding the Advance Fuels Laboratory (AFL) and the consequence of sudh flooding. The AFL, which is located in the basement of Building 102, is down grade from the lake bed. The NRC performed a Preliminary Safety Evaluation Report (PSER) dated November 7,1977.

In the PSER, the staff considered the possibility

-of flooding the AFL due to seismically induced dam failure which creates a ramote possibility of contaminating water supplies. At the time of the issuance of the PSER, there was a large working inventory of Special Nuclear Material (SNM) in the AFL which was factored into the staff's considerations.

In your letter requesting the refilling of Lake Lee, you state that in August of 1979 the process lines were shut down. At that time decontamination and decomissioning was begun. Currently in the basement vault in the AFL you state there are 26 grams of Pu, which are sealed in eight NDA standards.

One of the bases used in the 1977 PSER for determining the consequences of accident is an estimate of amount of material at risk. Material at risk is material that is in a location and condition such that it is available for possible release in the event of breach of confinement.

The amount of material in process or ready for process is generally, but not necessarily, the amount at risk for any radionuclide. Material encapsulated and/cr held in protective storage is not considered available for dispersion.

Recognizing the current situation as compared to the operations reviewed in the 1977 PSER, the staff agrees that the current inventory in the AFL does not represent the same probleu as encountered in the 1977 review.

and safety of the public. The basis of this statement is that the amount of material at risk is insignificant therefore eliminating the need to I

consider flooding of the AFL as a safety issue. The SNM present in the

AFL is in non-dispersible form.

In the event that G.E. intends to introduce any SM4 that would qualify as material at risk in the A.:L while Lake Lee is filled, G.E. shall submit projected plans on the use of said material. Prior to the initiation of the proposed operation, the NRC will review the hydrological impact on Building.102 and determine the acceptability of the proposed plans.

With G.E.'s acceptance of this restriction the staff grants GE permission to refill Lake Lee.
