This refers to the special security inspection conducted by W. J. Tobin of this
office on December 10-11, 1980, of activities authorized by NRC Operating License
No. DPR-33 at Browns Ferry Nuclear Plant and to the discussions of our findings
held with H. Abercrombie at the conclusion of the inspection. As a result of
this inspection, Region II issued a Confirmation of Action Letter on December 19,
1980. On January 7,1981, an Enforcement Conderence was held in the Region II
office attended by E. F. Thomas and others of your. staff.
Areas examined during this inspection included your physical security program as
implemented under the provisions of Title 10, Code of Federal Regulations,
Part 73, " Physical Protection of Plants and Materials" and the specific require-
ments of your approved Security Plan.
Within these areas, the inspection
consisted of selective examinations of procedures and representative records,.
interviews with pe: sonnel, performance tests, and observations by the inspector.
During the inspection, it was found that certain activities under your license
appar to violate NRC requirements.
This item and references to pertinent
requirements are listed in the Notice of Violation enclosed herewith as Appen-
dix A.
Elements to be included in your response are delineated in Appendix A.
Details of activities involving safeguards and security measures are exempt from
disclosure in accordance with 10 CFR 2.790(d). Therefore, your response should
be incorporated in a separate paper and referenced in your reply.
The specific violation of NRC requirements described in Appendix A was a failure
to control access to the protected area. Such a violation is categorized as a
Severity Level III under the Interim Enforcement Policy. Our inspection deter-
mined that security compensatory measures required by 10 CFR 73.55(g)(1) were in
effect at the time of this incident assuring the integrity of other safeguards
measures. The circumstances of this event have been reviewed with IE Headquarters
and a civil penalty will not be issued in this case.
In accordanca with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,
Title 10, Code of Federal Regulations, activities involving safeguards ~ and
security measures are exempt from public disclosure; therefore, the enclosures
to this letter with the exception of the report cover page, which is an inspection
summary, will not be placed in the Public Document Room.
