SUBJECT:
AMENDMENT TO CONSTRUCTION PERMITS - HARTSVILLE NUCLEAR PLANT By letter dated October 31, 1980, you requested amendments to Construction Permit Nos. CPPR-150, CPPR-151, CPPR-152, and CPPR-153 for the Hartsville Nuclear Plant. You proposed deleting Attachment B, Part II, A and B to the construction permits which contain requirements for monitoring primary water quality and construction effects at llartsville to determine any effect from plant construction on water quality or aquatic biota of the Cumberland River.
This type of monitoring is controlled by EPA through the National Pollution Discharge Elimination System (NPDES) Permit No. TN 0027740, and is outside NRC's.iurisdiction and authority. As a matter. of law, we have concluded that the monitoring requirements in Attachmaat ", avt II, A and B should be deleted. Amendments No. 4 to CPPR-150, CPPR-151, CPPR-152, and. CPPR-153 are enclosed.
We have concluded that, since this is a ministerial action required as a matter of law, no environmental assessment need be prefered as a c'onditio'n precedent to taking the action.
The amendment does not involve significant new safety information of a type not considered by a previous Commission safety review of the facility.
It does not involve a significant increase in the probability or consequences of an accident, does not involve a significant decrease in a safety margin, and therefore, does not involve a significant hazards consideration. We have also concluded that there is reasonable assurance that the health and safety of the public will not be endangered by this action.
