Subject: NRC Inspection Report No. 50-312/80-2 0 ~~

This is in response to your letter dated October 17, 1980, in response to our
letter and Notice of Violation dated September 26, 1980.
After careful consideration of your response and discussions between members

of this office and Messrs. Dan Garner and Mark Padovan (NNR Project Managers),
,
we have concluded that your response to Item C of our Notice of Violation is
not acceptable as discussed below.
Although the design of the system in question meets the single failure criteria
as discussed in your letter of October 17, 1980, this does not in itself satisfy
the requirement of 10 CFR, Part 50, Appendix A, Criterion 23, which states,
in part, that, "...the Protection System shall be designed to fail into a safe
state or into a state demonstrated to be acceptable..." As currently designed,
a loss of DC power to the valve operator solenoids will result in a loss of
the required redundancy within the system.
In consideration of the above, with regard to Item C of our Notice of Violation

dated 3eptember 26, 1980, please provide to this office within ten days of
the date of your receipt of this letter a written statement or explanation
in reply including:
(1) corrective steps which will be taken by you and the
results achieved; (2) corrective steps which will be taken to avoid further
violations; and (3) the date when full compliance will be achieved.
Should you have further questions concernin'g this matter, we will be glad to
discuss them with you.
