Dear Mr. Dircks:

There is presently a proceeding before an Atomic Safety and Licensing Board to consider Northern Indiana Public Service Company's (NIPSCO) request for amendment of Construction Per-mit No. CPPR-104 to extend the latest date for completion of the Bailly Generating Station, Nuclear-1.

Several parties to that proceeding have also filed requests for action pursuant to 10 C.F.R. S 2.206.1/

Those requests are pending before the Director, Office of Nuclear Reactor Regulation (NRR).

The Director, NRR, from time to time corresponds with the petitioners under Section 2.206; copies of this correspondence have not been routinely furnished to NIPSCO by the Director, his staff, or counsel.

Two examples of such corresponcence (Director's letter of July 31 responding to a May 8 letter from an Assistant Attorney General of Illinois and Director's letter of August 25 responding to a June 5 letter from counsel for the City of Gary) came to our attention only through pleadings filed in the construction permit extension proceeding.

Although we understand that such letters are sent to the Public Document Room, that course does not result in timely availability of the letters.

Dircks Page 2 October 31, 1980 We request that NIPSCO be furnished, on a contemporaneous basis, with copies of all correspondence between NRC representatives and parties to the extension proceeding and/or petitioners under Section 2.206 for action with respect to the Bailly facility.

The Director's letters cited above also record the Staff's intention to meet with representatives of Illinois and the City of Gary et al. following NRC receipt of a report by the Federal Emergenc? Minagement Agency (FEMA) on evacuation times for areas in the vicinity of the Bailly site.

We additionally request that NIPSCO be invited to attend any such meetings.

I shall appreciate prompt receipt of your response to these requests.
