SUBJECT:
FORTUNA INVESTIGATION on September 25, 1989, commissioner Rogers, as Acting Chairman, referred Judge Rosenthal's interim report on investigation 89-02 relating to Mr. Roger Fortuna to me, so that I could provide it to Mr. David Williams for review after his confirmation.
Upon receipt of the Acting Chairman's memorandum of referral, I discussed ths. matter with Mr. Williams.
I suggested and he agreed that it would be desirable to obtain an expert review of the interim report, and of the transcribe 6 tape recording of the January 14, 1987, conversation between Mr. Fortuna and Mr. Conley, by a neutral third party.
I arranged for such a review by Mr. J. Brian Hyland and a copy of his report to se is attached for your consideration relating to Mr. Fortuna.
Mr. Hyland has had a long and distinguished career in Federal law enforcement which included service as a special Agent and Inspector with the FBI, Director on the Surveys and Investigations staf f of the House Appropriations Committee, and the Inspector General for the U.S. Department of Labor from 1983-1989.
He received a Meritorious Executive SES rank award from President Reagan in 1983 and advised NRC's Office of Investigations shortly after it was established in 1982.
At several points in his report, Mr. Nyland indicates that certain aspects of Mr. Fortuna's conduct are a matter for the deciding official (pp. 6,7).
Mr. Eyland explained to me that by this he meant to say that the matter was something that was properly resolved between Mr. Fortuna and his supervisor as relating to 01 investigative practice and policy.
