NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-424/89-31 AND 50-425/89-36)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

S. G. Tingen on October 30 - November 3. 1989 and November 13 - 17, 1989, and

to the related telephone conference on November 17. 1989.

The inspection

included a review of activities autiorized for your Vogtle facility.

At the

conclusion of the inspection. the finiings were discussed with those members of

your staff identified in the enclosed Inspection Report,

Areas examined during the inspection are identified in the report.

Within

'

these areas. the inspection consisted of selective examinations of procedures

i

and representative records, interviews with perscnnel, and observation of

'

activities in progress.

The inspection findings indicate that certain activities appeared to violate

NRC reQuiremonts.

The violation and references to pertinent requirements are

described in the enclosed Notice of Violation.

,

The enclosed Inspection Report documents an oral consnitment (see paragraph 4)

made by a licensee representative and discussed in the exit interview.

If your

,

understanding of this consnitment differs from the report statements, please

inform this office promptly.

On Ncvember 17, 1989, a telephone conference was conducted between Region 11.

NRp. Olant Vogtle. Plant Farley. Georgia Power Corporate and Alabama Power

Corporate personnel.

The topic of this conference was to discuss the

November 15. 1989, memorandum from R. C. Jones to D. B. Matthews concerning the

Vogtle (and Farley1 Interpretation of Technical Specification (TS1 3.4.4

. l.imiting Condition for Operation. Relief Valves and its applicability.

This

memorandum is enclosed as Enclosure 3.

Based on this conference it is our

understanding that Plants Vogtle and Farley conrnitted to conduct testing

of the power operated relief valves (those not previously tested) on

November 17. 1989.

On November 17. 1989, this testing was performed

satisfactorily.

Enclosure 3 presents the NRR staff position that the satisfactory testing of

the automatic function of the relief valves is required to prove that these

relief valves are operable.

Since the corrective actions for this issue have been fully discussed and were

satisfactorily completed, a response to the Noti <,e of Violation is not

required.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2

Title 10 Code of Federal Regulations, a copy of this letter and its enclosures

wi'l be placed in the NRC Public Document Room.
