bjq Thank you for your letter dated November 21, 1980, which transmitted certain of the fees requested in our letter dated October 24, 1980, pursuant to the requirements of 10 CFR 170.22, for applications relating to your Ft. St. Vrain facility.
Fees were not paid by your Company for the March 11, 1980 request for exemption from performing an annual physical inventory of fuel storage wells because you considered this item a continuation of your September 19, 1979 request. The staff of the Office of Nuclear Reactor Regulation (ONRR) have reviewed this matter and agree with your position. On this basis, no fee is due for this March 11 submittal.
The other item for which no fees were paid is your September 8, 1980 application on temporary relief from LCO 4.3.10 because it was withdrawn by letter dated November 7,1980. The ONRR staff have informed us that no review of the September 8 application had commenced by them.
Under the provisions of 170.12(a), the Comission may retain fees for withdrawn applications; however, since the ONRR review staff had not started review of your application when it was withdrawn, we have concluded that an exemption pursuant to 170.11(b) from the fee requirements is hereby authorized by law and is otherwise in the public interest.
Our letter dated October 24 also requested a Class II fee of $1,200 for your October 25, 1979 application on plateout probe (P-79247). This fee was paid as part of the 518,000 remitted by your November 21 letter.
The ONRR
- taff have now informed us that they do not plan to review or to take action on this application.
Therefore, we have concluded that an exemption pursuant to 170.11(b) from the fee requirements fer the October 25 application is also in order and is hereby authorized by la', and is otherwise in the public interest.
We have authorized the Office of the Controller to refund a sum of 51,200 to your Company.
Refunds are generally processed within two weeks.
We thank you for your timely response to our letter of October 24, 1980.
