Dear Mr. Miller:

In your letter of October 24, 1980, you listed ten (10) applications from Fort St. Vrain for which f ees are due per the provisions of 10CFR Part 170.

In the enclosure with your letter, you listed two requests for exemption f rom performing annual physical inventory of fuel storage wells and as-sessed fees due in the amount of $4,000 for each request.

Only one request was submitted for an exemption f rom performing an annual physical inventory of fuel elements in the Fuel Storage Facility (Reference 1).

It was our understanding that the request had been denied, but that a waiver of one month had been granted and a continuation of that waiver was to be considered by the Nuclear Regulatory Commission. Subsequently, we requested that the waiver f or completion of the fuel storage well inventory be ex-tended until at L.ast August 1, 1980 (Reference 2).

That request was ap-proved by the Nucl. ear Regulatory Commission on April 9,1980 (Reference 3).

Since the two requests dealt with the same issue, we believe that only one fee should be due.

Mr. Willien O. M111sr Novembsr 21, 1980 Also listed on the enclosure was a request for relief from LCO 4.3.10 for which a fee in the amount of $1,200 was assessed.

Since that request was subsequently withdrawn on November 7,1980, we believe that a f ee is not required (Reference 4).

A check in the amount of $18,000 for the f ees due is attached.
