Dear Mr. O'Reilly:

Wr. offer the following response to the violation listed in the referenced inspection report.

NOTICE OF VIOLATION 10 CFR 71.5(b) requires that "the licensee comply with the applicable requirements of.. 49 CFR Parts 170-169." 49 CFR 173.393(j)(3) requires that rad ation levels shall not exceed ten millirem per hour at any point two meters (six feet) from the vertical planes projected by the outer lateral surface of the car or vehicle.

Contrary to the above, on Februar,7 10, 1981, one shipment of radioactive waste (AS 24614) was delivered to the Chem-Nuclear Services, Inc., of Barnwell, South Carolina burial site with radiation levels of 16 mR/hr at two meters from the vertical plane projected by the outer lateral surfaces of the vehicle.

Response: We agree with the violation as stated, however, it is our con-tention that this incident resulted from an instrument malfunction and not from deficien ies in our Waste Shipping Program.

All dose race instruments in use at this facility have been evaluated for geotropism. . l, J. P. O'Reilly Ref. RII:TCM/81 -May 26, 1981 as was used during calibration. The use of at least two (2) different radiation detection devices to perform the final vehicle e.it dose rate surveys on all radioactive shipment is now required by procedure.

An enhancement of compliance with the design criteria of the cask, by controlling the maximum radiation dose rates (hot spots) of the cask contents, has been instituted.

Full compliance has been achieved and no further corrective action is deemed necessary at this time.
