Dear Governor:

Thank you for your letter dated May 7,1981 concerning the decommissioning of the Uniteu Nuclear Corporation (UNC) facility at Wood River Junction, Rhode Islard.

Regerding some of the concerns mentioned in your letter, I can assure you that it has been the Comission's intention that the UNC site (facilities and grounds including the underground aquifer) must be decontaminated to levels acceptable for unrestricted release. is a copy of Amendment No.

10 to NRC's License No. SNM-777 which reflects this intent. ' Enclosure 2 is a Corporate Coi iitment'from UNC Resources, Inc. to fund this decontamination effort. is Licence Amendment No.17 issued on May 12, 1981, which deleted the expiratiori date of the license and provided that the license shall remain in effect until action is taken by the Commission to terminate it.

Regarding the survey of the unrestricted area, the Commission has contracted with Dak Ridge Associated Universities (0RAU) to survey the area. A repre-sentative of ORAU has visited the site, as you noted, and present plans call for ORAU to survey the area late this summer. A copy of the survey plan will be submitted to you'r staff for review and coment upon receipt from ORAU.

With regard to your concern about shipments of waste to the Beatty, Nevada burial site, we understand this may be due to certain restrictions imposed by Nevada. We furtner understand that DOE is considering your request to accept this waste.

If this were done, it would obviate the need to send the material to Nevada.

Either way, all such wastes will have to be removed from the UNC site prior to termination of the license.

I am confident that our staffs an reach aCreement on mutually acceptable decontamination standards and timing for termination of the license. We are ccmmitted to considering Rhode Island's views and concerns.

We have assigned Mr. W. T. Crow of the NRC staff to work with your staff in this endeavor.

Mr. Crow has spoken with Mr. Malcolm Grant of your staff, and they have agreed on a meeting date. You should recognize, however, thst NRC cannot enter into any formal agreement that would relinquish NRC's ultimate reguiatory responsibility r,d authority over this license.

In accordance with your application dated May 18, 1979, as supplemented February S,1980, and pursuant to Title 10, code of Federal Regulations.

Part 70, Special Nuclear Material License No. SNf4-777 is hereby amended -

to include your decomissioning plan and financial comitment.

Accordingly, Condition No. 21 is replaced with the following:

Condition 21. At the end of plant life, the licensee shall decontar3nate the facilities and site in accordance with the i.Q general decomissioning plan submitted in the enclosure to the letter dated May 18,1979,-so that these facilities 'and grounds can be released to unrestricted use.

The financial comitment fromDUNC Resources, Inc., to assure that funds will be available for decomissionir.g. given in the letter dated February 5,1.980, is hersby incorporated as a condition of the
