A special inspection conducted by the NRC Region II office on December 10-11, 1980 of activities at the Edwin I. Hatch Nuclear Plant, Units 1 and 2, in-dicated that inadequacies in the radiation control program resulted in release of contaminated materials.to unrestricted areas in excess of NRC requirem.ents.

The safety significance of this matter was discussed by telephone with W. E.

Ehrensperger of your staff on December 11, 1980, by James P. O'Reilly, Director of the NRC Region II office.

Your corrective actions were confirmed in a letter dated December 11, 1980, from the Region II Director to W. H. Miller, Jr.,

Georgia Power Company Executive Vice President.

This matter was identified by your employees and reported to the Region II office in a timely manner.

In addition, your subsequent action to correct the situation was expediticus.

Nevertheless, failure to establish and implement adequate procedures reveals a weakness in your control program for contamin-ated materials which created a substantial potential for release of radioactive materials in excess of 10 CFR 20 limits.

Therefore, we propose to impose civil penalties in the amount of $15,000 for the violations set forth in Appendix A to this letter.

The violations in Appendix A have been categorized at the levels described in accordance with the Interim Enforcement Policy as published in the Federal

Register (45 FR 66754), October 7, 1980. The base civil penalty value for a Severity Level III Violation is $40,000.

However, the Interim Enforcement Policy permits penalties to be reduced by as much as 50% if a licensee identi-fies, corrects, and reports a violation in a timely fashion.

We have concluded that your actions in this matter merit a full 50% reduction of the base civil penalty to $20,000. The Policy also permits a further reduction of up to 25%

for good faith by the licensee, as evidenced by extraordinarily prompt and comprehensive corrective action. We have concluded that your prompt action on your own initiative to remove contaminated soil as well as your comprehensive collection and analysis of waste oil samples from vendor facilities merit a good faith reduction and the $20,000 has accordingly been reduced to $15,000.

This reduction is an example of the potential benefit that may accrue when licensees act in good faith.

You are required to respond to this letter and should follow the instructions in Appendix A when preparing your response.

You should give particular atten-tion to those actions designed to assure continuing compliance with NRC require-ments.

Your reply to this letter and the results of future inspections will be considered in determining whether further enforcement action is appropriate.

A copy of this letter and the enclosure will be placed in the NRC Public Docu-ment Room in accordance with 10 CER 2.790.
