Notice of Violation This refers to the discussions between Mr. J. Rath of this office and yourself during the inspection of your facility conducted on January 16, 1981.

The sub-ject of one of the discussions was the fact that NRC records show that Special Nuclear Materials License No. SNM-1513 had expired on March 31, 1980 and a renewal application had not been filed in accordance with Section 70.33(b) of Title 10, Code of Federal Regulations not less than thirty (30) days prior to expiration of the license.

A renewal application had been filed dated June 16, 1980.

From our discussion we learned that you still possess material which requires a valid, specific NRC license.

Even though you had submitted a renewal appli-cation on June 16,1980,' you do not currently have a valid NRC license. Your possession of the material without a valid, specific license is a violation of Section 70.3,10 CFR Part 70. Section 70.3 states:

70.3 License requirements. No person subject to the regulations in this part shall receive title to, own, acquire, deliver, receive, possess, use l

or transfer special nuclear material except as authorized in a license issued by the Commission pursuant to these regulations.

This Notice of Violation is sent to you under the provisions of Section 2.201 i

of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations I

and is in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980).

Pursuant to the provisions of 10 CFR 2.201, Eastman Kodak Company is hereby required to submit to this office within five days of the receipt of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken; (2) correc'ive steps which will be taken to avoid this happening in the future. Under the authority of Section 182 of the Atomic I

Energy Act of 1954, as amended, this rerponse will be submitted under oath or affirmation.

Include a statement in your reply to this Notice of Violation confirming that you have taken this action and describing the controls that will be exercised over the stored material until such time that you obtain a valid license.

Your reply to this Notice of Violation shall be sent, within five (5) days of the receipt of this letter, to Region 1 U. S. Nuclear Regulatory Commission, Attention.
