O APPENDIX A NOTICE OF VIOLATION Maine Yankee Atomic Power Company Docket No. 50-309 License No. DPR-36 As a result of the inspection conducted on February 2-27, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

A.

10 CFR 50, Appendix B, Criterion XV statec in part:

" Measures shall be established to control... components which do not conform to requirements

,.. nonconforming items shall be reviewed and accepted... in accordance with documented procedures."

Plant Quality Assurance procedure 00-03-01, Rev 5; Material, Receipt, Handling and Storage states in part:

"4.9.1.3 A Hold Status Log shall be maintained by PEQAG indicating the status of all items that are on hold." and "4.10 A Non-Conformity and Disposition (N&D) Report shall be generated... and final resolution and approval received prior to placing a non-conforming part which is on hold in an operational condition."

Plant Quality Assurance procedure 00-08-01, Rev 5; Non-Conformance -

Materials, Parts, Components and Services states in part:

"4.2 An N&D report with final approval and resolution shall be required anytime that a safety classified material or component is placed in an operational condition while on hold status."

Contrary to the above, the motor operator on safeguard valve HSI-M-50 was installed in an operable status since March 8, 1980, with a hold tag attached and without status indicated in the Hold Control Log nor resolu-tion and approval of the non-conformity; and Contrary to the above, the six level switches for the safeguard pumps l

suction Recirculation Actuation Signal have been installed in an operable condition and in a hold status since December 31, 1980 without approval of the resolution of their non-conformity.

These items of noncompliance collectively represent a Severity Level V Violation (Supplement I.E).

B.

Technical Specification 5.8.1 states in part, " Written procedures shall be established, implemented and maintained covering... a. The applicable procedures recommended in Appendix "A" of Regulatory Guide 1.33."

Regulatory Guide 1.33, Appendix "A" states in part, "The following are...

safety-related activities that should be covered by written procedures...

1.j. Bypass of Safety Functions and Jumper Control."

Appendix A 2

Plant procedure 16.1, Rev 3, Maine Yankee Operation Safeguard dated March 8, 1979 states in part, "This procedure shall be used for any work requiring blocking... safety functions."

Contrary to the above, on Februa'y 3, 1981, the licensee failed to implement r

his Operation Safeguard Procedure prior to blocking the Engineered Safe-guards Features Recirculation Actuation Signal "B" train for maintenance.

This is a Severity Level V Violation (Supplement I.E).

Pursuant to the provisions of 10 CFR 2.201, Maine Yankee Atomic Power Company is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply including the corrective steps which have been taken and results achieved; corrective steps which will be taken to avoid further violations; and the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energ.y Act of 1954, as amended, this response shall be submitted under oath or aftirmation..
