Dear Mr. Kanner:
This is in further response to your letter dated April 7,1981 in which you requested, pursuant to the Freedom of Information Act, "all rules, regulations, actions, submissions to Congress, memorandum, correspondence and all other materials produced or received by the NRC as a result of or germane to" specified sections of the NRC Appropriation Authorization.
During a telephone conversation between you and Linda Robinson on April 21, 1981, the scope of your request was narrowed to records mentioned in Thomas A. Rehm's February 18, 1981 memorandum that,a sent to you on April 16,1981.
At this time we are able to provide you with the following information pertaining to each section of the Act ',n which you are interested:
Sec. 106:
The NRC report to Congress is presented in NUREG-0728, which is discussed in our April 16, 1981 letter to you.
Sec. 108:
The Office of Nuclear Reactor Regulation is currently preparing a memorandum for the Of fice of Muclear Regulatory Research that recommends numerical criteria for incorporation in the revised siting rule mentioned in the Advance Notice of Rulemaking published in the Federal Register on July 29, 1980.
The recommended demograpnic criteria are based on technical studies and were developed for light water reactors of the type and size currently being licensed.
Sec. 109(A):
The rule became effective in November 1980.
Those plants that were licensed prior to November 1980 were given the following period of time in which to implement the emergency plans:
1/2/81 - New plar.3 to be written.
3/1/81 - New plans to be submitted to NRC.
4/1/81 - New plans to be implemented at plants.

Within the next 12 to 18 months, NRC will conduct an in-house review of the plans.
An NRC staff team will then review the plans at the plants.
FEMA will review off-site plans and submit the plans to NRC for determinations by NRC of acceptability of the plans.

The NRC report to Congress is presented in NUREC-0755
" Report to Congress on the Status of Emergency Response Planning for NPPS", which may be purchased from the GP0 Sales Program (as noted in our letter of April 16,1981) at the price of $4.00.
Sec. 110:
A copy of SECY-81-13 is enclosed.
Sec. 207:
The proposed rule on safeguards information was published in the Federal Register on December 29, 1980.
Sec. 302:
Copies of the NRC 1979 and 1980 Annual Reports may also be purchased from the GP0 Sales Program at the price of $7.50 for each report.
Sec. 304:
A copy of NRC's comments on FEMA's interim " National Radiological Emergency Preparedness / Response Plan for Commercial Nuclear Power Plant Accidents (Master Plan)" published in the Federal Registe r_ on December 23, 1980 is enclosed.
Sec. 306:
NRC's report on this requirement a, aars in NUREG-0760
" Investigation into the Information Flow During the Accident at TMI", $10.00, which is also available at the GPO Sales Program.
Sec. 308:
The NRC report to Congress is presented in NUREG-CR-1728, "The Final Report on the Feasibility of Epidemiologic Investigations of the Health Effects of Low-Level Ionizing Radiation", $9.50, which is available at the GP0 Sales Program.
Recerds requested under Sections 302 and 307 are undergoing review for releasability determinations.
