We have reviewed your July 17, 1980 comments on our proposea Environmental Protection Plan (EPP) for McGuire Nuclear Station Units 1 and 2 and have modified the EPP as a result of concerns raised by your staff and of other applicants in the licensins process regarding aquatic environmental issues.

The new draft that is attached is consistent with the NRC staff effort to stancardize environmental programs for operating nuclear plants.

You will note that the " Issues" section has been consicerdoly aobreviated, as has the section on Review ana Audit. However, other requirements that your staff commented upon, such as for suomittal of evaluations of station design and operation relative to unevaluated environmental questions, and for submittal of an Annual Operating Report, remain. These requirements are consistent with our regulatians and, as explainea below, are also consistent with legisation pertaining to NRC's responsibility for environmental matters at operating nuclear power plants.

The issues addressed in the EPP, as modified, and protection of non-radiological-

environmental values are consistent with NRC responsibilities as defined in Tennessee Valley Authirity (Yellow Creek Nuclear Plant, Units 1 and 2)

In that decision, the Atomic Safety and Licensing Appeal Board found that hEPA does not autnorize NRC to impose water quality monitoring programs of its own. The Board did not decide that the NRC had no l

authority under NEPA to maintain cognizance of non-radiological environmental l

matters. Thus, under NEPA we are expected to be aware of environmental conditions at our licensed facilities (40 CFR 1505.3). This expectation extends to the aquatic segment of the environment. Reliance on the NPDES permit process to establish monitoring and reporting requirements for -
