Maine Corporation, Regarding a New Use of LAKE MICHIGAN (LITTLE TRAVERSE BAY) AND OTHER WATERS OF THE STATE, SECTION 8, HAYES TOWNSHIP, CHARLEV01X COUNTY. MICHIGAN ORDER OF DETERMINATION WHEREAS, Consumers Power Company, a Maine Corporation, has fileo with the Water Resources Commission a written statement dated March 28, 1960 for a new 1

use of waters of the state for disposal of wastes f rom a boiling water nuclear reactor steam electric generating station to be located in Sec-tion 8, Hayes Township, Charlevoix County, Michigan; and WEEREAS, the said written statement as supplemented by letter dated May 23, 1960 sets forth that Consumers Power Company proposes to discharge into Lake Michigan (Little Traverse Bay) cooling and condersing water, deminerall-zer regeneration wastes, laundry wastes, nilscellaneous process wastes from the operation and maintenance of a boiling water nuclear reactor together with treated human sewage, enumerates the amounts to be dis-charged and the, types and properties of substances contained therein, and further sets forth that certain facilities and methods are to be provided for treatment of said waste and human sewage; and WHEREAS, this Commission has caused an Investigation to be made of Consumers P w er Company's proposed waste control facilities, methods of disposal, the volume, character and ef fect of wastes to be discharged upon the waters of the sta'.e and has obtained counsel and advice from approprl-ate state and federal agencies relctive to said proposed waste disposal, and 8/oao66 35~A

Page 2 VHEREAS, the Commission, et its meet.cg on January 26, 1961, after due consider-ation to the s*.atement anc to investigations by its st af f of t he f actors involved in Consumers Power Company's new use of waters of the state, and after givino blic notice of its proposed action on said written statement and giving the opportunity to aryone concerned to place oral or written statements in the record at the meeting on December 15, having received no objections to the proposed new use,has determined that a pub-lic hearing is unnecessary and that the restrictions and conditions upon the use of Lake Michigan (Little Traverse Bay) as hereinaf ter set forth are necessary to protect the waters of the state against unlawful pollution; NOW THEREFORE BE IT RESOLVED that it is the order of this Commission that Consumers Power Company, its agents or successors, in using Lake Michigan (Little Traverse Bay) and other waters of the state for disposLi of wastes from its bolling water nuclear reactor steam electric generating station lo-cated in Section 8, Hayes Township, Charlevoix County, Michigan, shall comply with the following restrict. ions and condit ions:

A.

Waste discharges to Lake Michigan from all sources, either separately or combined, including but not limited,to cooling and condensing water, demineralizer regeneration water, boiler blow down, laundry waste, miscellaneous process wastes from the operation and maintenance of a boiling water nuclear reactor, and treated human sewage shall be in such condition that they will:

Contain co chemical substances in sufficient quantity to create conditions in Lake Michigan which are toxic to human beings, c'

animals, fish or aquatic life.

2.

Contain no oil in amounts sufficient to cause a noticeable. film on the surface or deposits on the bed or shore of Lake Michigan.

3 Contain no settleable or floating substances in amounts sufficient to create unnatural deposits of nuclear reactor or steam electric generating waste origin on the bed or shores of the receiving wa-ters in amounts which will interfere with the use of these waters for recreation, industelal enterprise, or lawful occupa*.lon or which will adversely af fect the gr owth and propagat ion of f.sh or aquat:c life therein.

Have a pH not greater than 9.5 or less than 6.0.

If the discharge Is a mixture of radionuclides in which the absence of Ra226 and Ra228 has been demonstrated by appropriate analysis, the concentration averageo over any 365 consecutive days shall net exceed 10-/ uc/cc above that of plant intake water from Lake Michigan; or c.

If all radionuclides present in the discharge are identi-fled, the concentrations shall be such that when averaged over any 365 consecutive days, the sumEl CI

C.

From and af ter the date of adoption of the Order the Company shall notify the office of the Chief Engineer of the Commission:

Immediately by telephone or telegraph when ar, accident or other situation occurs which results or may result in the release of radioactive ccntaminants tc the waters of the state in concen-tration which, if averaged over a 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> period, would exceed 5000 times the limi ts in A. (5) above.

3 Within 30 days by letter when an accident or other situation occurs which rer.ults in the release of radioactive contaminants to the waters of the state in concentrations which exceed 10 times the limits in A (5) above.

D.

The Company shall malte measurements of the wastes di schar ged to Lake Mich'gan (Little Traverse Bay) and shall perfcrm <uch aralyses as are necessary to dunons t rate tha t the r equi remente of th's 0? der are being met.

Reports of such analyses and measuremenIs shalI be available for inspection by authorized employees cf the Water Re-sources Corvnission ar.d an annual report thereof shall be submitted to the Commission by the Cecpany.

BE IT FURTHER RESOLVED that the aforesaid restrictions and conditions shall become effective as soon as any use is made of Lake Michigan (Little Traverse Bay) for disposal of wastes f rom its boiling water nuclear reactor steam electric generating station and shall remain in effect until further order of this Commission.
