Gentlemen:

This refers to the investigation conducted by Messrs. J. E. Foster,

F. C. Hawkins, C. C. Williams, J. Hughes, and E. R. Schweibinz of this

office on June 22, 25-29, July 7, 11-13, 17-20, 1979, of activities at

the Marble Hill construction site, authorized by NRC Construction Permits

No. CPPR-170 and No. CPPR-171, and to the discussion of our findings with

members of your staff.

The investigation corcerned allegations of improper repair and concealment

of honeycombed concrec.e areas at the Marble Hill site. These allegations

were substantiated. The enclosed copy of our Investigation Report iden-

tifies those areas examined during the investigation. Within these areas,

the investigation consisted of a selective examination of procedures and

representative records, observations, and interviews with present and

former site personnel.

The enclosed Investigation Report does not identify any items of noncom-

pliance with NRC requirements.

Items of noncompliance associated with the

allegations have been identified in previously issued Inspection Reports.

As you are aware, this report was referred to the Department of Justice

for review and possible criminal prosecution. At its request, the

report has been withheld until the recent conclusion of the Grand Jury

investigation.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and the

enclosed Investigation Report will be placed in the NRC's Public Document

Room, except as follows.

If this report contains information that you oc

your contractors believe to be proprietary, you must apply in writing to

this office to withhold such information from put:1c disclosure. The

application must include a full statement of the reasons for which the

information is considered proprietary, and should be prepared so that

proprietary information identified in the application is contained in

an enclosure to the application.

From our telephone conversation with you on November 10, 1980, it is our

understanding that this report will receive an expedited proprietary review,

and you will advise us of the results of your review via telephone by

November 13, 1980.

If your understanding is contrary to the above, please

contact us immediately.

We will gladly discuss any questions you have concerning this investigation.
