This refers to the routine inspection conducted by Mr. J. F. Pang of our Region V office on July 23, 1980, of a waste shipment arriving at the waste burial site in Richland, Washington from the Dresden Nuclear Power Station.
During the inspection the lid on one bin was found unfastened.
Further, the lid had no provisions to be fastened, suggesting inadequate quality assurance in your waste packaging operation.
It should be noted that about two months before this inspection a similar item of noncompliance, although of lesser significance, was identified concerning a waste shipment from the Quad Cities Station. We are concerned that broad corrective actions were not taken by Commonwealth Edison Company to prevent the recurrence of similar noncompliance.
As you know, NRC has taken steps to increase the standard of compliance in the area of transportation of radioactive waste materials.
The December 3, 1979 letter to all NRC licensees (44 FR 77135) set forth the criteria for categorizing violations in this area and stated that severity level I or II noncompliance normally would result in civil penalties or more severe enforcement action.
The fact. that the lid on one bin was unfastened has been categori:ed as a severity level II violation, based on the December 3,1979 guidance, because of an increase in the potential for personnel exposure or contamination.
As the result of our inspection of this matter, we propose to impose a civil penalty for the item of noncompliance set forth in Appendix A to this letter, in the total amount of Four Thousand Dollars.
Appendix B to this letter is a Notice of Proposed Imposition of a Civil Penalty.
You are required to respond to this letter, and in preparing your response you should follow the instructions in Appendices A and B.
