My letter to you dated May 15, 1980, enclosed the " Graduated Rescission of Order Dated August 15, 1979" and the guidelines (in the Appendix to the Graduated Rescission) for a controlled, stepwise resumption of activities at the Marole Hill site when certain prerequisites have been met.

I nave received your letter dated November 13, 1980, requesting further partial rescission of the Order dated August 15, 1979, in accordance with the guidelines referenced above.

Specifically, you stated that those activities identified in A, B, C, D, and E of the " Graduated Rescission of the Order Dated August 15, 1979" necessary to authorize resumption of construction by Cherne Contracting Corporation (CCC) and Commonwealth-Lord (C-L J.V.)

had been completed.

You requested written permission as required by Section E.3 of the referenced guidelines to allow resumption of mechanical and piping work by CCC and and electrical work by C-L J.V.

Pursuant to the NRC hold points in items C.3 and 0.3 of the restary. program, NRC inspectors have inspected o1justments by CCC and C-L J.V. which satisfy items C and D of the referenced program.

Activities identified in item E.2a had been initiated and have been in progress since the termination of construction work.

The program adjustments required under items E.2a and E.2b have been satisfactorily performed by CCC and C-L J.V.

We expect contin-uation of efforts identified in item E.2a by the remaining contractors.

Based upon the inspection findings by Region III, which confirm the infor-mation reported in your November 13, 1980. letter, I have concluded that the prerequisites necessary for resumption of electrical work and piping work by the two firms, C-L J.V. and CCC, have been completed satisfacto:-ily.

Accordingly, PSI is authorized to allow these two firms to resume construction work in the specific disciplines for which they were contracted, subject to the following conditions:

1.

Fabrication and component assembly may be performed without limitations.

2.

Components, piping, conduits, cable trays, or other equipment which'are to be mounted on or secured to concrete structures may not be installed until 8012230 27(

all concrete and emoecment nonconformances and open items, including the cadweld qualification issues involved in the proposed installation, have been resolved to the satisfaction of NRC Region III.

This authorization is consistent with paragraph E.3 of the Appendix to the

" Graduated Rescission of tha Order dated August 15, 1979."
