Dear Sir:
We expect that Item B of the Notice of Violation of the subject inspection shall be deleted based on past intercommunications.
With respect to Item A of \\ppendix A, discussions with Mr. Paul Fuller, a Eimith Physicist e= ployed L,' American Nuclear Insurers, indicates that his review covered all areas noted in your referenced letter. Our license SNM-368 requires that the results of the review be documented.
It does not require that an audit be completely " documented activity performed in accor-dance with written procedures or checklists to verify, by examination and evaluation of objective evidence, that applicable elements of the radiation protection program have been developed, documented, etc.".
The November 28, 1979 ANI letter, previously forwarded to you, meets our license requirements for reporting results and observed deficiencies.
Inspec-tion for item-by-item compliance by the NRC has demenstrated an excellent health physics protection program at our facility, as measured by the minimum number of inspection comments.
