Gilligan, Jr. President 800 Boylston Street Boston, Massachusetts 02199 Gentlemen: Thank you for your letter dated March 10, 1980 (BEco Ltr. #80-41) informing us of your corrective actions for the item of noncompliance contained in our Notice of Violation dated February 15, 1980. We acknowledge receipt of your check in the amount of Five Thousand Dollars (55,000) in full payment of the civil penalty proposed in our letter of February 15, 1980. With respect to the corrective actions documented in your March 10, 1980 letter, we verified during an inspection conducted on January 17-18,1980 that: a. The identified procedural changes had been performed. b. The station policy requiring that only the Chief Radiological Engineer or Senior Radiological Staff Engineer had the authority to issue final approval for the release of radioactive waste had been implemented. As a result of a series of telephone conversations during the period May 1-9, 1980, between an NRC fnspector and a member of your staff at the Pilgrim site, we have received verification that all appropriate personnel have been rein-structed in radiation survey techniques, proper shielding installation, and transportation regulations as stated in your March 10, 1980 letter. The train-ing documentation was also verified an site by an NRC resident inspector on May 8, 1980. You indicated in your March 10, 1980 letter that you believed the reason for your violaton of transportation regulations was a " normal fluctuation in radiation survey instrumentation due to t X % in calibration of instruments and the sensitivities of different types of, instruments." We do not agree with that conclusion since it has been established that your Waste Management Supervisor was informed of results of surveys performed by two different individuals which indicated that the' dose rates at two meters were substantially e .801106026F 9

The decision of your Waste Management Supervisor to permit the shipment to leave your site, after being informed of the survey results exceeding the regulatory limit, was the cause of the item of noncompliance.
