Dear Mr. Backus:

As you may kno.1, the Commission has declined to review my decision (DD-80-6, 11 NRC 371) of February 11, 1980, in which I denied your petition for action under 10 CFR 2.2'J6 concerning Public Service Company of New Hampshire's Seabrook Statira. Your petition on behalf of the Seacoast Anti-Pollution League had requested relief based on concerns related to emergency planning and severe accident considerations.

While my February lith decision was pending before the Commission, you wrote the Commissioners on June 30, 1980, concerning the status of their determina-tion whether to review my decision. Although the Commissioners declined to review the February lith decision, the Commission has referred your June 30th letter to me for consideration as a separate petition under 10 CFR 2.206.

I olan to consider your June 30, 1980, letter as a request pursuant to 10 CFR 2.206 for an Order. suspending or revoking Seabrook Construction Permit Nos.

CPPR-135 and CPPR-136.

In accordance with the Commission's request, a staff evaluation of the additional contentions in your June 30, 1980 letter will be completed for my consideration in deciding whether to institute proceedings or to again deny your basic request.

In accordance with 10 CFR 2.206 para-graph (b) I will inform you within a reasonable time whether your request will again be denied or whether you have provided sufficient additional bases to now justify a decision to initiate the requested voceedings.

I enclose for your information a copy of the notice that will be filed for publication with the Office of the Federal Register.
