APPENDIX A NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket Nos. 50-317 50-318 Based nn the results of an NRC inspection conducted on February 4-29, 1980, it appears that certain of your activities were not conducted in full compliance with the conditions of your NRC licenses Nos. DPR-53 and 69 as discussed below.
Items A and B are infractions, Items C and D are deficiencies, Item B applies only to DPR-69.
A.
Technical Specification 6.8.1 states in part:
" Written procedures shall be established, implemented and maintained covering the activities referenced below:
- a. The applicable procedures recommended in Appendix 'A' of Regulatory Guide 1.33, November,1972..."
Appendix "A" of Regulatory Guide 1.33, November 3,1972 states in part C, " Procedures for Startup, Operation, and Shutdown of Safety Related PWR Systems", that:
" Instructions for energizing, filling, venting, draini.ng, startup, shutdown and changing modes of operation should be prepared, as appropriate, for the following systems:.. 19
...b...(1)
... Emergency Power Sources (e.g. diesel generator, batteries)..."
Contrary to the above, as of February 6,1980, Operating Instruction 21, Emergency Diesel Generators, Revision 11, dated August 29, 1979 was not appropriate for changing modes of operation; in that the Shutdown Section did not have appropriate precautions to prevent Shutdown of the Diesels with a starting signal present.
Consequently, all three Unit 1 and Unit 2 Nuclear Power Plant Diesel Generators were made inoperable for a period of about 10 minutes on February 2,1980 when a nearly simultaneous shutdown by the Control Room Operators of the three Diesels was perfonned with a Unit I Safety Injection Activation Systems Starting signal present for all Diesels.
B.
Technical Specification 6.9.1.8, Prompt Notification with Written Followup, states in part:
"The types of events listed below shall be reported within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> by telephone and confirmed by telegraph, mailgram, or facsimile transmission to the Director of the Regional Office, or his designate no later than the first working day following the event... f. Personnel error or procedural inadequacy which prevents or could prevent, by itself, the fulfillment of the functional requirements of systems required to cope with accidents analyzed in the SAR..."

Contrary to the above, the February 2,1980 inoperability of the Diesel Generators 21 and 22, required to be operable because Unit 2 was operating at power, was not reported to the NRC until February 5, 1980, when the Resident Inspector became aware of this event through record review.
FSAR section 14 assumes availability of at least one diesel generator for the design basis loss of coolant accident (offsite power is assumed to be lost coincident with the accident).
Loss of both Diesel Generators would, by itself prevent the fulfillment of the functional requirements of the Emergency A. C. Power System during a loss of coolant accident.
C.
Technical Specification 6.5.1.6 states in Part "The P0RSC shall be responsible for:... e. Investigation sf all violations of the Technical Specifications including the preparation and forwarding of reports covering evaluation and recommendations to prevent recurrence to the Manager - Electric Product. ion Department and to the Chairman of the Offsite Safety Review Committee.
Contrary to the above, as of January 1,1980 the P0RSC did not perform the above investigation for violations of the Technical Specifications identified in NRC Inspection Report Numbers 317/79-02 and 318/79-02; 317/79-05 and 318/79-05; 317/79-07 and 318/79-06; 317/79-11; 317/79-13 and 318/79-10; and 317/79-18 and 318/79-15.
