Subject: .NRC Region I Inspection Report No. 50-333/89-10

.This letter transmits the results - of the routine inspection conducted by

Messrs. W. Schmidt and R. Plasse of this office on September 7,1989 through

October 7,1989, at the James A. FitzPatrick Nuclear Power Plant, Scriba, New

York. Mr. Schmidt discussed the inspection findings with you and other members

of your staff at the conclusion of the inspection.

The. inspection reporc has one unresolved item concerning the operability of the

- A core spray subsystem when work with the potential to drain the vessel was

,

l performed on September 19, 1989.

At the time only one of the two instrument

trip systems was functional.

This instance was noted by one of' your Shift

,

. Supervisors and reported.

Your staff then reviewed the issue and . assured

themselves that Technical Specifications were not violated and' revoked the

notification. ;We question this position.

In a' telephone call with this office on October 16,.1989, you committed to

.

maintain both trip systems operable to an ECCS injection system, when it is

required to be operable to support cold shutdown operations with a potential

for draining the vessel.

We accept this commitment until your Technical

-

-Specifications are revised to fully address this issue. Please include in your

'

response to this letter a description as to why you feel that you complied with

your : current Technical Specifications on September 19, 1989, and a date by

<

which your amendment submittal-will be made.

The inspection identified two violations.

The first violation concerns missed

. Technical Specification audits.

There appears to have been no method of

i

ensuring ' that these audits were properly completed, leading to several not

i

being conducted.

This is of concern because these audits are to be completed

'

under the cognizance of 'your Safety Review Committee (SRC), but the SRC vas

apparently unaware of the lack of these audits. The second violation is that a

'

e

licensed operator verified a prerequisite to a surveillance test incorrectly,

,

causing loss of shutdown cooling when the test was begun. You are required to

i

respond to this letter.
