Uc have reviewed your letter of October 29, 1976 discussing mitigating circunstances regarding the items of noncompliance identified in our letter of August 13, 1976.
In view of the several meetings and ex-change of correspondence between the Huclear 'legulatory Co c.ission and the Consuuers Power Company re;;arding the noncompliance items identified in the " Notice of Violation," we are concerned that an apparent mis-understani.ing exits relative to the issues involved.
In this regard, we wish O reiterate our basic concern that the Consumers Power Company quality assuranec/ quality control program did not identify the cause or O
recurring nature of the inpropor placen2nt of reenforcement steel in U
safety-related concrete structures such that repetition could be pre-vented.
Although we agree that your explanation of =1ti::ating circunstances is not completely documented in our reports and corres-pondence, it is our position that your explanation of mitigating circumstances does not change the noncompliance.
As Messrs, llayos and Jordan of our Region III offico discussed with you by phone on Hovember 17, 1976, we are not in coaplete agreement with several of the comraents contained in your letter. However, based on your stated understanding of our concerns and the need for the corrective action detailed in your letters of June 18 and Juac 24, 1976, further correspondence relative to these natters docia tot appear necessary or varranted.
