NOTICE OF VIOLATION

[

Duke Power Company Docket Hos. 50-369 and 50-370 McGuire Units 1 and 2 License Nos. NPF-9 and NPF-17 i

During the Nuclear Regulatory Commission (NRC) inspection conducted on July 22 through September 12. 1989, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy (and Procedure for NRC and

[

Enforcement Actions." 10 CFR Part 2. Appendix C 1989), the violation is identified below-Licensee Technical Specification Table 6.2-1 requires a minimum shif t crew, when either unit is in Mode 1 through Mode 4. of one Shift Supervisor, one Senior Reactor Operator, three Reactor Operators, three Auxiliary Operators, and one Shift Technical Advisor.

NUREG 0654 states that this is the minimum shift necessary to assure the safe shutdown of a two-unit plant, when one of the plants is in an emergency condition, t

Selected Licensee Comitment (SLIC) 16.13-1. Fire Brigade, requires that a Fire Brigade of at least five members shall be maintained onsite at all times.

The Fire Brigade members cannot include members of the minimum l

shift crew necessary for the safe shutdown of the plant.

Licensee Procedure. OMP 2-2. Shift Turnover, requires that each shift

[

verify that minimum shift staffing requirements and Fire Brigade staffing requirements are inet.

Contrary to the above:

(1) During the periods of June 1989 to August 1989, the licensee routinely l

failed to follow Procedure OMP 2-2 by not properly documenting the' minimum shift crew's presence.

No objective evidence exists that the

Technical Specification requirements and the SLIC requirements were l

being met.

L (2) Licensee Procedure OMP 2-2. Attachment la was inadequate, in that it 1

l allowed members of the minimum shift staff to also be assigned to the

l Fire Brigade.

In the event of an emergency situation. involving a fire, the ability of both the Fire Brigade to respond to the fire and l

the minimum shift staff to bring both units to safe shutdown may have been reduced.

Pursuant to the provisions of 10 CFR 2.201. Duke Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear l

Regulatory Commission, ATTN: Document Control Desk Washington, DC 20555 with a copy to the Regional Administrator Region II, and a copy to the NRC Resident Inspector, McGuire Nuclear Station within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) admission or I

denial of the violation (2) the reason for the violation if admitted (3) the corrective steps which have been taken and the results achieved (4) the corrective steps which will be taken to avoid further violations, and (5) the i

date when full compliance will be achieved.

Where good cause is shown, i

consideration will be given to extending the response tirse.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken, FOR THE NUCLEAR REGULATORY COMMISSION
