Dear Mr. Berry:
This refers to the telephone conversation between you ano Mr. James M.
Allan, Deputy Director of this office on April 23, 1980 regarding the findings, to date, of an inspection of the physical protection program at James A. Fitzpatrick Nuclear Power Plant by Mr. Bailey of this office.
The inspection commenced on April 14, 1980 and is continuing.
This also refers to the meeting held on April 24, 1980 between Mr. W. Boston and other members of your staff and Messrs. W. Martin and J. Devlin of nty staff at which findings of the inspection were discussed.
With regard to the matters discussed during the meeting on April 24, 1980, we understand that you agree to take the actions outlined in the attachment to this letter. We also understand that the actions required have either been completed or have been initiated, as indicated in the attithment to this letter.
In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, documentation of findings of the control and accounting procedures for safeguarding special nuclear materials and facility security procedures are exempt from disclosure; therefore, the attachment to the letter will not be placed in the Public Document Room.
If your understanding of the planned actions is not in accordance with the attachment to this letter, please contact this office by telephone and in writing immediately.
