By letter dated March 4, 1980, you withdrew an application dated February 1, 1980, which requested an exemption from 10 CFR 50.46 until improvements to the emergency core cooling system could be made for the Rancho Seco Nuclear Generating Station.
By letter dated Februray 22, 1980, your company remitted a Class 111 fee of $4,000 for the February 1 application.
The fluclear Reactor Regulation Review staff has advised us that no action on your February 1 apolication had conrenced.
Under the provisions of 170.12(a), the r.ommission raay retain fees for withdrawn applications; however, since the Nuclear Reactor Regulation Review staff has advised us that no review of your application was started, we have concluded that an exemption pursuant to 170.ll(b) from the fee requirements is hereby authorized by law and is otherwise in the public interest. On this basis, we have authorizcJ our Office of the Controller to refund a sum of $4,000 to your company.
The refund will be sent to you as soon as it can be processed by the Controller's office.
