Dear Mr. Rusche:

Facility Operating Licenses DPR-38, -47 and -55 authorize the operation of Oconee Nuclear Station, Units 1,2 and 3 respectively.

In each of these licenses, Condition 2E states:

" Pursuant to the Act and 10 CFR Parts 30 and 70, to possess, but not separate, such byproducts and special nuclear materials as may be produced by the operation of the facility."

i The term " facility" as described in the license is the applicable unit and associated equipment. This wording of the license creates a condition which prohibits transfer of byproducts and special nuclear material from one of the Oconee units to the other.

It is considered that this wording was unintentional at the time of issuance of the Facility Operating Licenses since justification does not exist to segregate the byproduct and special nuclear material produced from the operation of one Oconee unit from that j

produced from the other essentially identical units.

One example of NRC 1

approval of transfer of material between units was the safety evaluation supporting the issuance of Amendments 17, 17 and 14 to Facility Operating Licenses DPR-38, ~47 and -55 respectively.

This amendment indicated that spent fuel from Oconee Units 1 and 2 would be transferred to the Oconee Unit 3 spent fuel pool which is being modified for increased fuel storage.

Therefore, pursuant to the provisions of 10 CFR 50 5 50.90, the following changeisrequestedtoCondition2E,Mf-the,FacilityOperatingLicenses o

It is requested that approval of this amendment to the Oconee Facility Operating Licenses be approved by April 1, 1976 in order to facilitate the handling of components during the Oconee Unit 2 refueling.
