Durina, our review of your application for a construction permit for the proposed Davis-Besse Fuelear Power Station, we requested the corcents and recom:nendations of the U. S. Department of the Interior, Fish and Wildlife Service, concerning the radiological i= pact of the proposed facility on the areas of responsibility of thr> Fish and Wildlife Service.
A copy of the Fish and Wildlifo Service Report, dated July 14, 1970, with an attached pamphlet dealing with " Diversion and Collection of Juvenile Fish with Traveling Screens" is enclosed for your information.
Cocies of this report, and the attachment, are also being sent to the appropri-ate state and local officials. The radiological safety aspects of the naterial in the report will ', e considered in the evaluation of the safety of your project by the regulatory staff and the Advisory Com=ittee on Reactor Safeguards. Our conclusions will be included in the safety evaluation which we prepare for the public hearing to be held to con-sider the issuance of a construction permit for your proposed u-sit.
We call your attentica to the recocnendations of the Fish and Wildlife Service as they relate to the Davis Besse Nuclear Fower Station and request that you cooperate with the Service in developing your detailed plans for radiological surveys.
The reports which you will submit on the preoperational rurveys will be evaluated by the Cocraission and by the Fish and Wildlife Service at the cine we consider your application for a provisional operating license in this proceeding. The reports of surveys made after operations have begun will be s4.milarly reviewed. At such time as you begin inaking these reports, you are requested to furnish directly to the Commission twenty copies, and we will forward copies of the reports to the Fish J

The Toledo Edison Company JUL 2 71970 Matters discussed in the Fish and Wildlife Service Report properly relating to our responsibilities under the National Environmental Policy Act will be handled in accordance with the Interim Guidelines of the Council on Environnental Quality and our proposed revision of Appendix D to 10 CFR 50.
To this end our April 24, 1970 letter requested information from you on the environnental impact cf the Davis-3 esse plant.
Matters relating to water quality will be handled in accordance with the requirements of the Water Quality Improvement Act, which amends certain sections of the Federal Water Pollution Control Act. Ragarding these Acts, an applicant for a construction permit and operating license for any nuclear power plant which will discharge effluents into the navi-gable waters of the United States ia required te provide the AEC with a certification from the State or interstate pollution centrol agency, or the Secretary of the Interior, as appropriate, that there is reasonable assurance that the plant vill not violate applicable water quality standards. In the case of the Davia-Besse nuclear Pouer Station, which had an application pendin;; on the data of enactment of the Act, the Act provides that if a construction permit is issued for the plant before April 3,1971, the applicant must submit a water quality certification to the AEC within one year from the Jate the constructien permit is issued or the permit vill terminate at the end of the one year period. Thereaf ter, the AEC :nay not issue a permit or license for the plant until a water quality certification first has been received.
We recognize, as indicated in the Service's report, that the release of large amounts of chemically treated, hectad vater into Lake Erie might have adverse effects on fish and wildlife resources.
"e wish to call these matters to your attention and urge that you give then full consideration in line with the Service's rececmendations con-carning these potential nonradiological effects upon the environment of the proposed operation of the Davis-Besse Nuclear Power Station.
