LEO MCDONOUGH, PROJECT MANAGER OPERATING REACTORS, BRANCH NO 1 RE:
WITHHOLDING OF INFORMATION PURSUANT TO 10 CFR S 2.790 I have reviewed the staff's determination to withhold from public inspection, at the request of Duke Power Company, Babcock and Wilcox's " PROGRAM FOR INSERTION OF ZIRCONIUM OXIDE SPACERS IN OCONEE 1, BATCH 4".
While the request and the staff's determination to withhold meet the form requirements of 10 CFR S 2.790, I am unable to conclude that disclosure of the model would, as a matter of fact or law, reveal data or material con-cerning Babcock & Wilcox or customer funded research or development plans or programs of present or potential competitive advantage to Babcock and -
Wilcox. I appreciate that a full discussion of the bases for the' staff's con-clusion could achieve the same result as making the model itself available i.e. disclosure to the public. With this understanding, I have concurred in the proposed letter to Duke Power Company.
