Dear Mr. Keppler:

The following is in response to an inspection conducted by Mr. J. Barker on December 3, 1979 - January 4, 1980, of activities at Dresden Nuclear Ebwer Station, Units 1, 2, and 3.

Reference (a) in-dicated that one item appeared to be in noncmpliance with NRC require-ments. Attachment to this letter contains Ccrmonwealti Edison Company's response to the identified item on nonempliance.

Infraction Based on the inspection conducted on Decen=er 3,1979 - January 4, 1980, it appears that certain of your activities were in noncompliance with NRC requirements, as noted below. This item is an infraction.

Unit 1 Technical Specifications, Section E.2.B, requires that radiation control procedures be maintained, made available to all station personnel, and adhered to. Radiation Control Standcrds Procedure 37-1-E-3,

%rk in Controlled Areas (Radiation Areas and High Radiation Areas),"

requires that personnel not eat, drink, smoke, or cb.ew in those controlled areas.

Contrary to the above, on December 20,19~9, while making a routine tour of the Unit 1 turbine building (a posted radiation area),

the NRC inspector observed evidence of eating, drink.ing, s: Toking, and chew-ing (i.e., the presence of numerous cigarette butts, empty soft drink cans, empty candy wrappers, and enpty chewing gum wrappers > in this radiation area.

Wis is a repetitive item of nonempliance since the same problem was identified previously in NBC Inspection Report No. 50-010/79-19, dated October 18, 1979.

Oorrective Action Taken and Results Acheived Areas where evidence of eating, drinking, and smoking was found were cleaned up. Patrols were instituted by manager-snt, supervisors, and the guard force in an attempt to determine the indiriduals involved. As of February 11, 1930, the following individuals were found violating the the NRC Radiation R otection Rules:

On February 1,1980, a contractor workman in the Unit 3 Reactor Bui]d.ng was found srtoking in a controlled area. A meeting was subsequently held with the contractor's management to re-review Radiation Protection Rules.

2.. On February 6,1980, a workman was seen by a security guard carrying food through the D2 and D3 tin bine building. We workman'was discharged.

Corrective Action Taken to Avoid Further Noncmpiinnce On January 10, 1980, a meeting was held with all contractor's management by Ccmmonwealth E:lison construction supervision and the station management regarding violation of station procedures. The events leading i

to the infraction were discussed, and the contractors were informed of the following:

1.

Every supervisor or foreman must ensure that all individuals employed by him understand and comply with the Rules for Radiatic7 Protection.

2.

If an individual is found disregarding the Rules for Radiation Protection, employment at the station will be terminated.

3.

The individual's intnediate supervisor and the contractor's management will be contacted to explain the violation.
