20555 In the Matter of DUKE POWER COMPANY (Amendment to Materials License SNM-1773 for Oconee Nuclear Station Spent Fuel Transportation and Storage at McGuire Nuclear Station)
Gentlemen:
Enclosed is a copy of the Testimony of Brett S. Spitalny prefiled in preparation for the hearing scheduled for the week of April 28, 1980, in Charlotte, North Caml ina. The purpose of Mr. Spitalny's testimony is to update the record uitn respect to the proposed license amendment since the adjournment of the hearings in September 1979. Mr. Spitalny's testimony updates the record with ras; = to:
(1) Duke Power Company's schedule for implementing various altaractives for handling and storage of spent nuclear fuel from its Oconee reactors, (2) the current status of the NRC Staff's review and approval for spent fuel casks, and (3) an application for authorization to use pin compaction to increase spent fuel storage capacity at the Maine Yankee nuclear reactor facili ty.
Also enclosed for the information of-the Board and the parties is a Supplemental Staff Report related to Spent Fuel Storage of Oconee Spent Fuel at McGuire Huclear Station, Unit 1.
A prior Staff Report was introduced as NRC Staff Exhibit No. 33 at the September 1979 session of these hearings. That Staff Report covered three areas, namely, the cask drop analysis, physical security at the McGuire site, and physical security of spent fuel in transit.
Due to the consideration of the confidentiality issue by the Commission at the time of the September hearings, pages 6 and 7 of NRC Staff Exhibit No. 33, dealing with physical security of spent fuel in transit, were stricken from that Exhibit and only the portions of the Exhibit dealing with the cask drop analysis and with physical security at the McGuire site were admitted into evidence.
(See Tr. 4646-4647.) The' enclosed Supplemental Staff Report summarizes the Staff's review of the Applicant's and shipper's proposals to meet the requirements of the Interim Rule,10 C.F.R.

I am also enclosing three (3) affidavits executed by Jack N. Donohew. The two Donohew affidavits dated April 10, 1980 complet9 the Staff's response to the Licensing Board's Order of October 31, 1979..L/ The third affidavit-by Dr. Donohew modifies Tables 1 and 2 of Dr. Donohew's affidavit dated January 11, 1980 which was previously submitted to the Licensing Board.
I am also prefiling with this letter copies of documents that have been labeled, respectively, as the Testimony of Jack N. Donohew, Testimony of Charles R. Marotta, and Testimony of Edward Lantz. These documents put the Staff's affidavits of February 8, 1980, in a question and answer format. The Board's Order requested that the record be supplemented in response to the Board's question concerning a postulated cask drop accident.
It is our intent, however,,to request at the hearing that the Licensing Board admit into evidence the affidavits served on the Board and the parties on February 8,1980, and the affidavits of Jack N. Donohew on occupational dose exposure served with'this letter.
We believe that this is the appropriate method for completing the record on this matter since this supplemental information is in response to a Board question, and is not directly related to the cask drop contention of Carolina Environmental Study Group admitted by the Licensing Board at the September 1979 hearings.
(Tr.4181.) Carolina Environmental Study Group's contention involves the issue of whether the truck cask could fall into the licGuire Unit I spent fuel pool.
Thus, unless otherwise requested by the Licensing Board, we do not intend to have Messrs. Donohew, Marotta, and Lantz present at the forthcoming hearings scheduled for the week of April 28,1980.
