i LICENSEE'S MOTION TO COMPEL ANSWER BY UCS TO LICENSEE'S INTERROGATORY NO. 8-1 3

On January 18, 1980, Licensee served upon UCS a first.

set of interrogatories. Interrogatory No. 8-1 read as follows:

"8-1. Copies of Babcock & Wilcox ("B&W") documents concerning small break analyses will be-suppliedito-UCS counsel under separate cover. 'Does UCS contend:

in the light of the information contained in such documents that sufficient analyses have not now been done to show that there is adequate protection for the entire-spectrum of small break locations?' If so, explain the inadequacies which UCS contends exist in the analy'ses performed to date and' describe in detail i the further analyses which UCS contends should be.

performed."

By letter dated January 22, 1980, Licensee's counsel delivered by hand.to UCS' counsel' material describing small break analyses prepared by B&W applicable to TMI-1.

On February 25, 1980, UCS objected to Interrogatory No. 8-1. UCS' objection in full was as follows:

"The Union of-Concerned Scientists objects to Licensee Interrogatory No. 8-1, which asks UCS to review some 6 inches of technical documents pro-vided by licensee and to explain the inadequacies of the documents.

"The interrogatory is unduly burdensome and overbroad. If-the licensee wishes to refer UCS '

to particular sections of the documents, properly focussed interrogatories may possibly be fashioned.

In its present form, it poses an undue burden on UCS."

Licensee's Interrogatory No. 8-1 was addressed to,

and designed to elicit the specific bases for, UCS Contention 8, which alleges the need for additional analyses to show that there is adequate protection for the entire spectrum of small break locations and that none of the corrective actions to date have fully addressed the " demonstrated inadequacy" of protection against small breaks. Licensee is certainly entitled to require an identification of the alleged inadequacies in corrective actions to date. The materials supplied to UCS describe small break analyses performed by B&W, including additional analyses since the TMI-2 accident, and were intended i to facilitate UCS' identification of any inadequacies it still believes to exist. As to UCS'. complaint that it is burdensome to review the material provided, Licensee is at a loss to understand 'how UCS can claim, much' less support a claim of, inadequacies in small break analyses without-familiarizing itself with the' analyses which have been performed. .

Licensee's counsel has been unable to' reach ~an agreement with UCS' counsel which would. avoid the necessity for this motion to compel, the time for which motion expires l
