Braitman As requested, your Report to the Director of Regulation on the A'!TITRUST R"VIFR OF LICE!!SE A"PLICATIO:I FOR CRYSTAL RIVER INIT 3: FLORIDA POUER CORP. has been reviewed by cy staff. The introductory language and the proposed format for the license conditions and accorpanying explanatorv notes are acceptable to us.

With respect to the proposed recoerendations as stated on page 3 of the report, we have the following coerents:

1.

We concur with recoerendation a).

However, it is surgested than an additional recommendation be included which provides for Comission approval of this Florida Power Corn. approach for processing future antitrust matters where the Attorney General recommends license conditions in lieu of an antitrust hearine.

2.

In view of the above recomnendation, we su9: rest also that your recommendation b) be rodified to read " Note that in future cases, where the Attorney General recommends license conditions to avoid antitrust hearings, those proposed conditions will be approved by the Director of the Directorate of Licensine with concurrence by the Office of Antitrust and Indernity and the Of fice of the General Counsel.'

Appendix B which is specified in reconnendation c) is absent fron the material which you forwarded and it is presured to be so by intent.

If our suggestion 1 above is adopted, the procedures for handline, this type of antitrust matter in the future vill be uniforn for all applications.

In that case, it is. judged reasonable that the Directorate of Licensine with concurrence by OCC and OIA resolve such matters without Comission Consent.
