0502-02 OBJECTIVES To assure that proper actions are taken to protect health and a.

safety and the environment and property from the consequences of incidents which occur as a result of NRC-licensed activities; and to assure that the public is kept informed of actual or potential hazards to health and safety arising from such incidents.

To obtain early. comolete, and factual information regarding incidents as a basis for reports to the Commission, senior NRC management, and the Joint Connittee on Atomic Energy.

c.

To evaluate the circumstances relating to incidents to determine the causes thereof and appropriate measures to prevent recurrence.

To provide a basis for the improvement of codes, guides, and q

standards for accident prevention, radiation protection, and safeguarding of hazardous material.

To coordinate NRC contingency planning and incident response e.

0502-04 DEFINITIONS 041 Incident. Any occurrence which, by itself or its consequences, poses an actual or potential hazard to health and safety, property, or the environment, or an actual or pote'ntial threat to the safeguards for licensed facilities or material.

042 Incident Manacement Center (IMC). A facility at the East-West Towers Builcing, Bethesda, Maryland, cperated by the Office of Inspection and Enforcement to support the response to incidents which require extensive coordination between the NRC and other agencies.

043 Incident Response Action Coordination Team (IRACT). A group of officials of the Office of Inspection and Enforcement assigned to initiate the response actions required by NRC contingency plans dealing with incidents.

044 Contincency Plans. A planning and guidance document containing a series of preconceiveo decisions and actions by the NRC for dealing with incidents:

Safeguards contingency plan - deals with threats, thefts, and a.

sabotage relating to special nuclear material, high-level i

radi'oactive wastes, and 1.icensed nuclear facilities.

b.

Radiological safety contincency plan - deals with incidents relating to the safety of-licensed operations and any radio-logical hazards which may result from those operations, including radiological hazards resulting from safeguards incidents.

NOTIFICATION & RESPONSE ACTIONS FOR IllCIDENTS NRC Appendix 0502 PART I CONCEPT AND REQUIREMENTS FOR INCIDENT RESPONSE ACTIONS A.

GENERAL Under the direction of the Director, Office of Inspection and Enforcement, the Incident Response Action Coordination Team (IRACT),

the Regional Office staff, and the Incident Management Center (IMC) provide the resources and capabilities to initiate and coordinate NRC's response to incidents.

Other Offices and Divisions of the NRC support the IRACT and operation of the IMC, providing technical advim and assistance in contingency planning, response actions, and logistical support.

B.

IRACT The IRACT is composed of management officials and alternates of the -

Office of Inspection and Enforcement.

Continuity is maintained in the direction of incident response actions through a succession and delegation of authority stipulated in procedures established by the Director, Office of Inspection and Enforcement. These procedures designate an operating cadre for the IMC to assist the IRACT in the discharge of its responsibilities.

C.

IMC The NRC actions taken in response to an incident which require extensive direction and coordination and timely exchange of infor-mation between NRC and other agencies is accomplished from the IMC.

The IMC is manned during these times by the IRACT and necessary support staff and operating cadre.

The IMC is connected to appropriate comunications services and contains inforniation and information handling aids sufficient to facilitate an understanding of the impact of the incident on licensed activities and public health and safety, and to provide support for the coordination and monitoring of NRC response actions.

D.

INCIDENT RESPONSE ACTIONS 1.

Initial Determinations Reports and notifications of incidents involving NRC licensees are normally received by Regional Offices.

The Director of the Regional Office receiving the report of an incident makes the initial detennination of the severity level of the incident

Investigators or inspectors will be sent to the incident scene if appropriate.

The initial response actions by the Region for Level I and Level II incidents includes prompt notification of Headquarters IE Division of Field Operations, or the HQ Duty Officer during non-working hours.

Incidents (and response actions) may be escalated to a higher level than that assigned on the basis of preliminary notifi-cation.

Conversely, incidents and response acti.ons may be de-escalated if, in the process of followup, information is obtained which warrants such an action.

2.

Level I Action The official of the Division of Field Operations receiving the,

initial report (or the HQ Duty Officer) will notify the most senior IRACT member available who will initiate the Headquarters response actions.

The IRACT will direct and coordinate the initial actions taken'in response to Level I incidents which have particularly significant health and safety, safeguards, or public interest aspects; that is, those incidents determined to be of severity Level I which present an actual or imminent serious:thr.ut or hazard and require extensive coordination and exchange of information and advice between the NRC and several agencies.

In those cases the PiC will be activated, tile IRACT assembled, and NRC management notified.

The IRACT will notify other agencies and organizations and call upon other established emergency response organizations for support and assistance, if required.

The IMC and IRACT provide a central channel and source of information relating to the incident and periodic status reports to all concerned.

3.

Level II Action The preliminary notifications for Level II incidents are essentially the same as for Level I.

The initial actions taken in response to Level II incidents, however, are normally under the direction of only one (or more) members of the IRACT, according to the category of the incident, with Headquarters j

actions being accomplished primarily by the Ilic operating cadre.

The number of agencies involved and the coordination required usually will not require the full resources of the IMC or IRACT.

Level III Action The primary responsibility for dealing with Level III incidents remains with the Regional Office.

E.

REVIEW AUTHORITY When an incident has particularly significant health and safety, safeguards, or public interest aspects, the actions taken by the NRC and other authorities involved may be reviewed by a Headquarters Incident Investigation Review Committee.

This Committee executes the actions described in Part III of this Appendix. The Executive Director for Operations determines, with respect to incidents reported to him or otnerwise brought to his attention, whether the incident should be reviewed by the Committee.

F.

BASIC REQUIRD1ENTS 1.

Office of Inspection and Enforcement Designates and provides written instructions for members of a.

its.' Headquarters and Regional Office staff who serve as Duty Officers during non-working hours to assure continuing l

capability for implementing response action procedures.

Establishes appropriate contacts with other Federal agencies, and with State and local agencies, for the purposes of noti-fications of incidents and coordinating necessary response actions.

Provides a central channel and source of information relating to the incident, and periodic status reports to all concerned.

Notifies the appropriate Office or Division of ERDA, or the ERDA Emergency Action Coordination Team (EACT), immedi-ately of an incident involving NRC licensees when NRC expects or anticipates that assistance and support from ERDA will be required, e.

Requests that ERDA provide a representative as liaison to NRC's IRACT to keep ERDA informed of the course of events relating to the incident, NRC response actions, and assis-l tance and support required from ERDA by the f:RC.

f.

Notifies the appropriate Office or Division of ERDA, or 1

the ERDA EACT, immediately of all incidents believed to involve ERDA activities or operations; g.

At the request of ERDA, promptly provides an NRC repre-sentative as liaison to ERDA to keep the NRC informed of l

the course of events relating to the ERDA emergency, ERDA response actions, and any assistance and support required from NRC by ERDA.

h.

Contacts the Federal Bureau of Investigation (FSI) when notified of an incident involving safeguards threats or where there is alleged or suspected criminal violation of Federal laws, and in cooperation with the FBI:

(1) provides all available facts including copies or the contents of any threat messages, identity of threaten-ing parties if known, etc., and (2) assists, as required, in the assessment of the credi-bility of nuclear-related threats, including the asses-sment of threat messages or devices, search operations, identification and evaluation of radiological hazards, etc.

Coordinates with the NRC's Office of Public Affai~rs to advise the State Department Operations Center promptly of major incidents believed to have international implications, if such knowledge originates within the NRC;1/

Provides a representative or other assistance as requested to the State Department Task Force designated to handle a particular emergency condition resulting from an incident.

Notifies other Federal agencies and organizations as appropriate.

Assures that appropriate regional offices of Federal agencies and appropriate State and local agencies are notified of incidents.

G.

CRITERIA FOR NOTIFICATIONS Notification of an incident should not be delayed pending complete information.

Supplemental information will be gathered and reported as soon as it beccmes available.

When possible the initial report or preliminary notification of an incident will provide:

1.

time, date, location, and general nature of the incident, and its major consequences; 2.

whether the facts, as known, eliminate the need for further actions or inspectors at the scene; 3.

known significant details of the incident; effects or impact on the public and en the regulatory pregrc:; injuries, prcperty damage, actions being taken for control of the incident; status of actions taken or proposed by the NRC Office receiving the 4

report; and comments on possible causes of the incident; hj status of efforts, if known, to mitigate the consequences of the 4.

H.

COORDINATION WITH OTHER AGENCIES 1.

Energy Research and Develooment Administration A working arrangement has been agreed upon between the NRC and ERDA proYiding for mutual support and assistance in the response to incidents occurring in or affectin under jurisdiction of either agency, g facilities or activities In cooperation with the NRC, the ERDA has agreed to:

(1) Notify the NRC immediately of all incidents believed to involve tiRC or State licensee activities or. facilities,

(2) Provide technical advice and assistance as necessary, including capabilities of ERDA's Radiological Assistance Program, to support the NRC response to incidents which involve licensed activities and operations.

(3) At the request of NRC's IRACT Director, promptly provide an ERDA representative as liaison to NRC's IRACT.

(4) Coordinate any ERDA press relea e with NRC's Office of Public Affairs when an incident involves NRC or State licensees.

Federal Bureau of Investication (FBI)

The FBI has the lead role in investigating threats and extortion ~

cases and alleged or suspected criminal violations of rederal law. Both the NRC and the ERDA have established liaison with the FBI to deal with incidents of.these types, The NRC has established contacts with the FBI for the purpose a.

of contingency planning and response actions for' incidents involving sabotage, terrorism, and theft of SNM.. Those incidents which involve nuclear-related threats require a three-way coordination between the FBI, the NRC, and the ERDA.

ERDA provides the FBI with primary nuclear technical support, -

including credibility assessment of threat communications, operational search capabilities, and infomation about the security of the weapons production chain. NRC provides a determination of whether sufficient SNM is missing or other-wise unaccounted for in a licensed facility as an input into the determination of threat credibility, and othemise assists in the threat assessment and the search-and-find mission within its capabilities.

b.

Suspected or alleged criminal violations of Federal' law are referred to the Department of Justice through NRC's Office of the Agency Inspector and Auditor (AIA).

The AIA, upon i

3 being notified, advises the FBI of the referral and coordi-nates with the FBI and the reporting NRC Office in any ensu-ing investigation.

GENERAL The NRC conducts a continuing public information program to keep the public fully and currently informed of incidents involving licensed facilities and activities.

It is a policy of the NRC to encourage licensees to take the lead in information activities relating to incidents and emergencies at their facilities.

B.

CRITERIA FOR PRESS RELEASES 1.

With due regard to the common defense and security, a press release'should be made for any incident covered by this Chapter which is believed to have public information significance.

2.

Press releases must be factual and must report accurately the licensee's position or statements about the incident. Additionally, press releases shall identify the equipment involved in the inci-dent and state whether.the equipment is ::afety-related or whether it is part of t)e " conventional" systems of the plant or facility.

NOTIFICATIONS AND RESPONSE ACTIONS FOR INCIDENTS NRC Appendix 0502 PART III PROCEDURE FOR HEADQUARTERS INVESTIGATION REVIEW OF INCIDE A.

GENERAL Except as otherwise prescribed by the Commission, an investigation of incidents is made under the direction of NRC's Executive Director for Operations as provided in this B.

CRITERIA FOR INVESTIGATION REVIEW Where an incident has particularly significant health and safety, safeguards, or public interest aspects, the results of any special inspection or documented record of the incident may be reviewed by the Incident Investigation Review Committee.

The Executive Director for Operations determines whether an incident is referred to the Committee.

C.

INCIDENTINVESTIGATIONREVIEWCOMMITTEE(IIRC) 1.

The Technical Advisor to the Executive Director for Operations shall serve as Chairman of the Committee.

2.

The members of the Committee shall be appointed, according to the type of incident and facility involved, frem Headquarters Offices and Divisions (line offices).

3.

There shall be no less than three members.

4.

NRC personnel directly involved in the regulatory licensing or inspection process of the facility or activity involved in the incident may serve on the Committee, but they shall not consti-tute a majority of the Committee nor serve as the only investi-gator of any subecmmittee or task group the Committee or Chair-man may appoint.

5.

The EDO may request the Executive Legal Director to appoint a.

counsel to the Committee; the counsel so appointed shall attend the meetings of the Committee and advise and assist it.

D.

PROCEDURES The following procedures apply to the investigation review activity:

1.

The actions of the Committee do not relieve the NRC line offices of their operational responsibility.

The Chairman of the Committee shall assure that committee actions do not interfere with the incident response and inspection actions carried out by the Office of Inspection and Enforcement.

NRC Appendix 0502 NOTIFICATIONS AND RESPONSE ACTIONS FOR INCIDEN 2.

The Director of Inspection and Enforcement shall assure that the Committee is kept fully and currently informed with respect to information and data obtained by his staff as a result of the incident.

3.

The Committee shall:

Review information gathered by inspectors or otherwise obtained a.

as a result of the incident.

b.

Review the information developed as a result of tha incident with respect to such matters as the nature of the incident, its causes, the safety of the operation, and matters to be considered in order to assure continued safety and to mini-mize or preclude similar incidents.

Advise whether additional investigation or inspection should c.

be conducted, and if so, in what particulars.

The Comittee may question witnesses and examine documents, equ'pment, faciliites, and sites relevant to the incident.

5.

If, after reviewing all information available and making such inquiries as it deems necessary, the Comittee determines that additional infonnation is necessary, the Directors of line Offices will be: requested to obtain and furnish :::ch infor=ct.icn.

6.

After completing its investigation review and prior to preparing its final written report, the Commit'ee shall consult with the Directors of line Offices as appropriMa, concerning the results of the investigation review to determine if any further revied is necessary or desirable.

7.

Thereafter, if it appears that no further review or action by the Commit, tee is necessary or appropriate, the Committee shall prepare a report to the Executive Director for Operations.

The report shall contain an evaluation of safety and safeguards aspects, both specific to the incident and on a generic basis, and a ccmplete sumary of the incident and actions taken by the NRC.
