Dear Mr. D' Angelo :
This is in response to Mr. D. P. Dise's letter dated January 19,1979 in which he requested, pursuant to the Freedom of Information Act, a copy of all past and present information relative to the Radwaste Reduction (RWR) System including all internal NRC documents as well as all cutside inquiries and responses. Mr. Dise also requested that your company be placed on the distribution list for all future information on this subject.
The request was received by the Office of Administration on Janua ry 25, 1979.
In your telephone conversation on February 16, 1979 wi th Mr. Frank W.
Karas of my staff, you agreed to bear the cost of reproducing t' ds subject to your request, which is $0.10 per page, as specifim'
- R 9.14(b), a copy of which is enclosed.
Mr. Karas also informed you that the NRC cannot honor your request to be placed on distribution regarding information subject to your request which comes int the possession of the NRC in the future. As Mr. Karas informed you, the Freedom of Information Act does not apply to records which would be created at a future date, but only to records which are in the possession of the NRC when a request is received.
Appendix A identifies F0I A requests which the NRC has received regarding the subject matter of your request.
Copies ci the requests, NRC responses, and documents disclosed to the requesters are enclosed.

Portions of documents 25, 26, 27 and 33, listed on Appendix B, are drafts or other documents containing advice, opinions, and recommendations of the staff and are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Infonnation Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
Copies of documents 25, 26, 27, and 33 listed on Appendix B, with the exempt portions deleted, are being placed in the f1RCPDR and LPDR.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
