Docket No. 70-2622 Transportation of Spent Nuclear Fuel from Oconee to McGuire Nuclear Station

Dear Members of the Board:

Attached hereto are copies of testimony that applicant intends tc> present at the upcoming evidentiary hearing.

Both these pieces of testimony relate to applicant's challenge to the Staff's denial of the utilization of route No. 4 as described in the Board's ORDER of March 10, 1980.

In addition applicant will present the testimony of Ralph W. Bostian, which testimony was filed with the Board on March 14, 1980.

As noted in our letter of April 2, 1980, NRDC has no objection to this testimony being received into evidence.

Lastly, applicant intends to introduce testimony of Mark Elliott and Lionel Lewis which testimony was filed with the Board and parties on September 4, 1979.

The September portion of the Lewis testimony simply completes the record with respect to health effects associated with the approved alternative routes.

The Elliott testimony is supportive of applicant's challeng? to the Staff's denial of the proposed primary route.

. Applicant will endeavor in the next two weeks to obtain stipulations to all or part of its prepared testimony.

We will keep the Board advised of our efforts.
