Results: Of the one area inspected, two apparent items of noncompliance were found. Deficiency - failure to transfer byproduct material pursuant to 10 CFR 30.41 (79-8-1); and Deficiency - failure to deliver licensee material to a carrier for transport pursuant to 10 CFR 71.5 (79-8-2).

Exit Interview The inspection scope and findings were summarized on December 11, 1979, with those persons indicated in Paragraph I above. The items of noncom-pliance were discussed in detail.

Unresolved Items Unresolved items are matters about which more information is required to determine whether they are acceptable or may involve noncompliance or deviations. A new unresolved item identified during this inspection is discussed in paragraph 7 below.

Waste Shipment to NECO a.

On October 13, 1979, the licensee made a shipment of irradiated fuel waste from the licensee's site in Lynchburg, Virginia to the NECO (Nuclear Engineering Company) waste disposal burial facility in Richland, Washington. The shipment consisted of two casks, Model No.

B3-1, Certificate of Compliance No. 6058, each containing 43,390 s

curies of radioactive material. The shipping documents, a single set for the two casks, showed a total of 86,780 curies from the shipment.

i The NECO license permits 60,000 curies. The licensee had misinterpreted

the NECO license by concluding that the 60,000 curie limit applied to each package (cask) when in fact the limit applies to each shipment.

At the request of the receiver (NECO), the shipping documents were amended to provide two sets of shipping documents, each showing a total of 43,390 curies. At that time NECO accepted the casks of material.

In November 1979 the licensee was informed by the NRC that this situa-tion had been highlighted to the Governor of Washington, Dixie Lee Ray. Consequently, the licensee management investigated the events of the shipment and initiated actions to prevent a recurrence.

During the inspection of this shipment, the inspector examined copies c.

of the shipping documents, the shipment records, the Certificate of Compliance No. 6058 and the licensee's investigation report. Licensee representatives were informed by the inspector that the transfer of radioactive material in excess of the receiver's license limit was an item of noncompliance with respect to 10 CFR 30.41 (79-08-01).

Shipping Documents During the review of the shipping documents (bill of lading) for the above shipment the inspector observed that " Radioactive Material, n.o.s." was used for the shipping name instead of " Radioactive Material, Fissile, n.o.s." as required by 49 CFR 172.101. Also, the shipping documents did not include the name of each radionuclide in the radioactive material that is listed in 49 CFR 173.390. The shipping papers listed 780 grams Pu, 43 grams U-235 and mixed fission products but did not refer to the other radionuclides of plutonium or uranium. The shipping papers incorrectly identified the shipment as fissile Class III where the certificate of compliance states that shipments under this certificate are fissile Class II.

Licensee representatives were informed that delivery of licensed material to a carrier for transport without shipping documents prarared in accordance with the requirements of 49 CFR 172.202 and 172.203 was an item of noncompliance with respect to 10 CFR 71.5(a) (79-08-02).

Certificate of Compliance Certificate of Compliance No. 6058 requires that the contents (radioactive material) be packaged within DOT Specification 17H steel drums or equivalent.

Licensee representatives stated that the inner containers were fabricated and tested at B&W

-LRC.

The individual responsible for performing the tests was not at the lab the day of the inspection and other personnel did not know where the test procedures and results or supporting safety analyses were kept. ' Licensee representatives were informed that the determination i

that the inner containers met specifications equivalent to DOT Specification 17H drums would remain an resolved item (79-08-03).
