Dear Mr. Kenna:

This is in response to the two items of noncompliance identified in the referenced inspection report.

A.1.

Subsequent to being notified of an irregularity in a shipment made on October 13, 1978, I instituted an investigation to identify problem areas and to make recommendations to prevent a recurrence. The investi-gation showed, as did the reference, that the Lynchburg Research Center (LRC) incorrectly interpreted the receiver's license limit by applying it to each container rather than each shipment.

Noncompliance will be avoided in future shipments by:

(a) Having a second individual review the completed shipping papers for all shipments of large quantities of licensed material to assure that they are properly completed and that the container's Certificate of Compliance and the receiver's license limit have been considered.

(b) Revising the " Radioactive Shipment Check List" to include space for entering the receiver's license limits.

(c) P.evising the " Radioactive Shipment Check List" to provide space for the signatures of the person completing the form and that of the reviewer's.

The above corrective action is scheduled for completion on February 28, 1980.

In the interim period, shipping documentation reviews are being performed.

I feel that the LRC is now in full compliance.

The LRC is presently reviewing, in detail, all requirements of 49 CFR as they pertain to shipping documents. The purpose of the review is to identify deficiencies in our shipping documents or the instructions for their completion. This review is scheduled for completion by January 31, 1980.

Further noncompliance will be avoided by revising the shipping document foms and instruction to correct any deficiencies identified in B.1 above.

The revision of shipping documents and instructions will be performed in conjunction with items A.2.(b) & (c) above, and is scheduled for completion on February 28, 1980.

In the interim period, shipping documentation reviews are being performed by a person other than the individual completing the foms to assure full compliance with the applicable regulations.

I feel that we are now in full compliance.

In reviewing the referenced report, I have identified two errors which you may want to correct before releasing it for public disclosure.

In the first paragraph of Appendix A, the date " December 31, 1974" should be changed to " December 31, 1979", and in the first line of item 5.2 of Report Details, the date " October 13, 1979" should be changed to " October 13, 1978".
